The following terms and conditions will govern any contract for sale and/or service that we enter into with you. Please read these terms and conditions carefully.

Definitions and Interpretation

The term 'Stratford Sewing' or 'us' or 'we' refers to the owner of the website. The term 'you' means the person placing an order for the goods and/or services and entering into contract with us.

General

The website and the products described in this site are subject to change without notice. Any information about products and services offered is intended for guidance only.

Copyright in the web site, its design, layout, look, appearance and graphics remain our property and all trademarks are acknowledged.

We will not be liable for any damage caused to your computer, your other hardware products, your software, data or other property as a result of your access to our website, or your downloading of any text, images or other material from our website, or emails you receive from us.

Purchasing

To purchase from us you must be over 18 years of age and resident in the United Kingdom.

We can only take orders and deliver goods in the UK only.

All prices and offers are subject to change and errors and omissions can occur.

If we discover that the you or we have made a mistake in the order then we will contact you before delivery of the goods and you will have the option to proceed with the changed order, cancel part of the order or cancel the whole order. Any monies owed to you will be returned in full. This contact will take place after the automated order confirmation email that is intended for guidance only.

All orders are subject to availability and on a first-come first-served basis as we are unable to reserve or pre-order Goods, and we shall have no obligation to accept any order but will inform you if we have not accepted an Order. In the unlikely event that we are out of stock when you place your order, you will be emailed to inform you of this cancellation.

After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. No contract for sale of any product will subsist between you and us until we dispatch the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by us of your offer to buy goods from us or a third party supplier that is engaged on your behalf by us (whether or not you receive that e-mail).

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, we may validate the names, addresses and other information supplied during the order process against commercially available records (e.g. Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. By ordering from our website you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. All information provided by you to us will be treated in accordance with the Data Protection Act 1998.

Delivery

Delivery dates are estimates only however we will aim to deliver your goods within the time indicated. Time and date of delivery shall not be of the essence and we will not be liable for any losses whatsoever as a result of any failure to meet any estimated delivery date or time.

If you intend to collect the goods then, they must be collected within 3 working days after the agreed collection date and delivery will be deemed to have taken place immediately upon you collecting them from our premises. If you have paid online using a credit card and you collect the goods, then you must bring your credit card with you so we can take a copy of the front and back of the card.

We may deliver the goods in several consignments but no additional charge will be passed onto you.

Title of the goods passes on full payment and until then the you must insure and store our goods separatley and in their original packaging without modification whatsoever.

Until title of the goods has passed we shall have the right at any time to repossess the goods whether they be at your premises or elsewhere. You shall be liable for all costs and expences in recovering the goods.

You must inspect the goods receieved promptly and in any event within 14 days. After this period, you will have accepted the goods.

Any items missing from the order must be reported to our Customer Services Department within 3 days of delivery.

In the event that the parcel has been damaged or tampered with on delivery, do not sign for parcel and return it back to courier. However, if you accept the goods then sign "damaged" and obtain the couriers signature. Keep all packaging as this will be required for any claims against couriers for damaged/missing items. You must report all damaged items to our Customer Services Department within 3 days of delivery.

Your right to cancel

You may cancel the contract within 7 days, starting from the day the goods are received, in writing to the Customer Services Dept. You must return the goods to us in an unused, unopened and re-saleable condition, and are returned to us within 7 days of delivery providing you have requested and being granted a Returned Material Authorisation (RMA) from our customer services team. Delivery of these goods to us from you is at your cost and we cannot accept liability for packages damaged during transit. Proof of postage is not necessarily proof of delivery and you are therefore advised to send your package by recorded delivery, registered post or courier and to maintain sufficient insurance to cover the value of the goods.

We reserve the right to refuse to accept returns of goods when the return of the goods is a physical impossibility or where the goods cannot be restored in the same physical state as they were supplied

Cosmetics and jewellery items cannot be returned due to current Health & Hygiene regulations.

We will refund you by the oringinal payment method, less cost of delivery of goods from us to you, within 30 days from our receipt of the returned goods by us.

Liability

We give no warranty that any goods supplied by the company are suitable for any purpose for which the customer may wish to use them and the customer shall establish the suitability of the goods for the customers purpose without reference to us and our website

To the fullest extent permitted by law, Stratford Sewing is providing this site and its contents on an 'as is' basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, Stratford Sewing does not represent or warrant that the information accessible via this site is accurate, complete or current.

Stratford Sewing does not accept liablity for any 1) loss of use of the goods or any indirect or consequential loss, 2) loss of business profits, salary, revenue, savings, 3) damage remided by Stratford Sewing within reasonable time, 4)loss avoidable by you through reasonable conduct, including backing up all data and following our reasonable advice generally. We will not be liable to you by reason of any product obligations, or for any loss or damage (whether loss of profit, data or otherwise) costs, expenses or other claims for compensation (or whether caused by the negligence of our employees or agents or otherwise) which arise out of or in connection with the goods supplied by us or their use or resale by you.

Force Majeure

Stratford Sewing is not liable whatsoever for any delays in performace and any failiure to perform all or any parts of its oiligations (incl. deliver and service) caused by circumstances beyond its control and will be entitled to a time extension for performace; examples include strikes, supplier/transport/production problems, natural disasters and govermental or regulatory action.

Either party may terminate this agreement without compensation should this last for more that 45 days.

Your Obligations

You are responsible for your own choice of product and its suitability for purpose it is intended. You are also responsible for postage and telephone charges in contacting us, if any.

Miscellaneous

No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.

All measurements are approximate.

We may amend these terms from time to time at our discretion without notice to you. Any amendments will be posted on this website and will supersede any terms and conditions previously published by us.

Law and Contract

Contracts for the purchase of goods through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
